  1. Introduction 

This Privacy Statement (“Statement”) explains how Integrity Express Logistics, LLC (“IEL”) collects, uses and discloses information that may be considered personal in nature (“personal information”). Throughout this Statement, IEL may be referred to as “we”, “us”, “our” or “IEL”.  

The information collected by IEL may not qualify as personal information under relevant law or otherwise be subject to regulation. Nothing within this document shall be interpreted to imply that any particular information collected or processed is personal information.  IEL is a non-asset licensed broker of property utilizing subcontracted independent motor carriers for all loads tendered to it by its business customers.  To the extent that personal information is collected, this policy provides transparency as to how said information is collected/processed and provides opportunities for individuals to exercise their rights under applicable law.   

This Statement applies to any personal information you provide to IEL and any personal information we collect when you contact us, visit or use our websites or applications, visit an IEL location, attend IEL events, request a service from us or use other services that refer to or link to this Statement (each, a “Service”). The information we collect varies depending upon the nature of the Services we provide and how you interact with us. This Statement may be supplemented by additional privacy statements, terms or notices relevant to the applicable Services.  

IEL is responsible for, or administers, the Service and is also responsible for processing the information provided to us or collected by or for the Service.   

As used herein, all references to “Site” may include, individually, all and/or in any 

combination, IELFREIGHT.COM, INTXLOG.COM, BLOG.IELFREIGHT.COM/CARRIERS, 

BLOG.IELFREIGHT.COM/CUSTOMERS IELJOBS.COM, IELNEXUS.COM, 

IELFRESH.COM AND IELLANES.COM, as well as other websites, domains, and 

subdomains operated by or on behalf of Integrity Express Logistics, LLC, and also includes 

mobile applications including but not limited to IEL NEXUS customer mobile application 

and/or IEL LANES carrier mobile application. The Site is maintained by Integrity Express 

Logistics, LLC.  

IEL does not sell your information to third parties. In certain circumstances, IEL may transfer your personal information to third parties as described below. 

The Site is not intended for children under 13 years old.  If you believe that a child under the age of 13 has submitted personal information on an IEL Site, please contact IEL as directed under Section 13.  

  1. Collecting your information 

We collect information in order to offer the Site and Services that you may request. This information is collected in accordance with applicable laws, regulations, and industry standards.   

  1. Types of Information Collected 

Examples of the information that IEL collects may include, but is not limited to, the following 

  • contact information and other unique identifiers (such as your name, email address, physical or postal address, phone number or unique personal identifiers such as social security numbers or other government identification numbers/information (where required)); 
  • information you provide in order to create an account with us or to access the Site, such as user name/ID, password, and other information used for authentication purposes; 
  • information provided in relation to employment or prospective employment at IEL (please see IEL Careers Privacy Policy statement found here; 
  • information to used to pay for services rendered by IEL or other business financial information, such as information provided to obtain credit from IEL relating to Services provided by IEL;  
  • customer support information, performance data, and other diagnostic data related to the use of the Site. 
  1. Sources of Information 

We collect personal information about you in the following ways: 

a. Information you provide directly to us: we collect personal information about you when you request a Service from us; visit the Site; apply for a position at IEL; through your use of our Services; provide comments, feedback or communicate directly with us.    
b. Information from your organization: we may obtain personal information about you from the organization with which you are employed or affiliated, in order to provide Services and/or manage your access to and use of the organization’s Service.    
c. Information we collect automatically: we may collect certain types of information about you automatically when you use our Services, visit our Site or communicate with us online or through the e-mails that we may exchange. We may collect this information through the use of “cookies” or similar technologies such as web beacons, gif or pixel tags or other unique identifiers to measure online activity, provide more relevant advertising or analyze the effectiveness of communications or our promotional campaigns. d. Information from third parties: we may collect personal information about you from other third parties, including but not limited to, recruitment agencies, credit reference agencies, government bodies, and insurance companies. 
  1. Impact of failing to provide information 

You are required to provide certain information (in an acceptable form) necessary for IEL to meet its obligations in connection with the Services requested of it, including legal and regulatory obligations. Where you fail to provide information requested by IEL, it may be unable to offer Services to you and/or we may need terminate any ongoing Services.   

  1. Processing your information 

We will use the information we collect about you to: 

 Offer, deliver and administer the Services;  
 exercise due diligence in business dealings, including, but not limited to, collecting information for identity verification, credit references, and otherwise vetting for business relationships or potential employment;    
 process payments, including but not limited to, payments from Customers and to Third Party Carriers; 
 review, investigate and settle claims or complaints in relation to the Services provided; 
 Assist in the prevention, discovery and investigation of fraud and/or criminal activity;  
 enforce our agreements, trace debtors and recover any outstanding debt in connection with the Services provided; 
 fulfil legal and regulatory obligations;  
 transfer books of business in the event of an acquisition or reorganization, including the planning and due diligence purposes both prior to closing and after a transaction has closed; 
 process applications for employment and inform recruitment decisions; 
 Analyze business trends; 
 Research to improve and/or expand the Service; 
 communicate with you;  
 audit, legal review, reporting and other business operations purposes; 
 any other purposes from which consent is given at the time the information is collected/submitted or when consent can reasonably be inferred under the circumstances.  For example; a customer submission of a credit application with references identified shall be considered consent to contact said references with regard to customer’s credit worthiness.   
  1. Legal grounds for processing 

We rely on the following legal grounds to collect and use your personal information: 

 Performance of the Service   Where we offer Services or enter into a contract with you to provide Services, we will collect and use your information where necessary to enable us to take steps to offer you the Services, process your acceptance of the offer and fulfil our obligations in the contract with you.   
 Legal and regulatory obligations The collection and use of some aspects of your personal information is necessary to enable us to meet our legal and regulatory obligations.  
 Preventing and detecting fraud We will use your personal information, including information relating to criminal convictions or alleged offenses to prevent and detect fraud and other crimes.   
 Legitimate Interests  The collection and use of some aspects of your personal information is necessary to enable us to pursue our legitimate commercial interests.  For example, we have legitimate interests in:  providing Services;  operating our business, and managing and developing our relationships with clients, vendors and with you;  understanding and responding to inquiries;  receiving information from third parties and IEL affiliates to provide services;  sharing data in connection with mergers and acquisitions and transfers of business;  improving our Services; and  understanding how our customers use our Services and Site.  Where we rely on this legal basis to collect and use your personal information, we shall take appropriate steps to ensure the processing does not infringe the rights and freedoms conferred to you under the applicable data privacy laws. 
 Consent Where we rely on your consent to collect and use your information, you are not obliged to provide your consent and you may choose to subsequently withdraw your consent at any stage once provided. However, where you refuse to provide information that we reasonably require to provide the Services, we may be unable to offer you the Services and/or we may terminate the Services provided with immediate effect.   
  1. Accuracy of your information 

We rely on the availability of accurate personal information in order to provide the Services to you and operate our business. You should therefore notify us of any changes to your personal information, particularly changes concerning your contact details, bank account details, insurance policy details or any other information that may affect the proper management of the Services provided to you. 

  1. Recipients of your information 

We generally share your personal information with the following categories of recipients where necessary to offer, administer and manage the Services provided to you: 

 within IEL: we may share your personal information within IEL for the processing purposes outlined in this Statement;   
 vetting and risk management agencies: such as credit reference, criminal record, fraud prevention, data validation and other professional advisory agencies, where necessary to prevent and detect fraud and take steps to assess the risk in relation to prospective or existing Services; 
 legal advisers and claims investigators/adjusters: where necessary to investigate, exercise or defend legal claims, cargo claims, insurance claims or other claims of a similar nature; 
 law enforcement bodies: where necessary to facilitate the prevention or detection of crime or the apprehension or prosecution of offenders; 
 public authorities, regulators and government bodies: where necessary for us to comply with our legal and regulatory obligations; 
 third party suppliers: where we outsource our processing operations to suppliers that process personal information on our behalf; 
 successors of the business: in the event IEL engages in an acquisition or merger with another organization, in whole or in part. Where personal information is shared in these circumstances it will continue to be used in accordance with this Statement; 
 business partners: such as joint venture entities and/or other third-party business partners who collaborate or co-operate with IEL on projects, events, products or Services. You should refer to their privacy notices for more information about their privacy practices; and 
 internal and external auditors: where necessary for the conduct of company audits or to investigate a complaint or security threat. 

Third-Party Service Providers 

In order to support our Services, maintain operations, and make employment decisions, IEL may share information with third-party service providers.  Our service providers may utilize systems that allow for the collection of personally identifiable information.  

IEL utilizes Google Analytics to collect non-identifying information, including operating system, screen resolution, browser, language, country, and city. This information is used to detect trends in the usage of the Site and not to individually scrutinize a certain user’s history. Reports are made regarding usage of certain pages on the Site and distributed to management.

IEL may also link to other third-party service provides on or through the Site or as part of its Services.  

Information collected by third party companies is not covered by IEL’s privacy policy.  IEL bears no responsibility for the content of these websites or the information that you may submit to them.  We urge you to read the privacy policies of said websites before submitting any information.  

  1. International transfers of your information 

The Site is hosted in the United States. However, IEL’s operations extend beyond the United States.  When necessary to provide services, we may transfer information about you to affiliates, partners and third party vendors in other countries to be processed for the purposes outlined in this Statement. In doing so, IEL will take all necessary steps to comply with applicable data privacy laws and regulations. 

If you are not a resident of the United States, please be aware that your use of the Site/Services and submission of information is taking place outside of your home jurisdiction.  

  1. Retention of your information 

We retain appropriate records of your personal information to operate our business and comply with our legal and regulatory obligations.  To the extent that you wish to have information removed from our records, a request can be made pursuant to Section 13 below.   

  1. Information Security 

The security of your personal information is important to us, and we have implemented appropriate security measures to protect the confidentiality, integrity and availability of the personal information we collect about you and ensure that such information is processed in accordance with applicable data privacy laws. 

  1. Your Information Rights 

10.1 You have the following rights in respect of any personal information we collect and use about you: 

 Access: right to access and inspect your personal information or be provided with a copy of the information being held about you.   
 Correction: a right to request the correction of your personal information or in cases where the accuracy of information is disputed, to supplement the information to give notice that you dispute its accuracy.   
 Erasure: a right to request the erasure of your personal information, particularly where the continued use of the information is no longer necessary.   
 Processing: a right to object to the use of your personal information, particularly where you feel there are no longer sufficient legitimate grounds for us to continue processing the information.   
 Direct Marketing: a right to object to the use of your personal information for direct marketing purposes. See Section 11 below for further information.   
 Restricted Processing: a right to request the restriction of your personal information from further use, e.g. where the accuracy of the information is disputed, and you request that the information not be used until its accuracy is confirmed.   
 Portability: The right to request that some aspects of your personal information be provided to you or a third party of your choice in electronic form to enable its reuse.   
 Lodging a Complaint with a Regulator: a right to complain to the relevant data protection regulator about our processing of your personal information. See Section 12 below for further information.  

10.2 It is important to note, however, that some of the rights described above in Section 10.1 can only be exercised in certain circumstances. If we are unable to fulfil a request from you to exercise one of your rights under applicable data privacy laws, we will write to you to explain the reason for refusal. 11. Direct Marketing 

We will use your personal information to send you direct marketing about Services that we feel may be of interest to you. We will give you the opportunity to refuse direct marketing at the point that you apply or register to receive the Services and, on each occasion, thereafter that you receive direct marketing communications from us. You can also change your marketing preferences at any stage by contacting us. Please note that, even if you opt out of receiving direct marketing communications, we may still send you service-related communications where necessary. 

12. Complaints 

12.1 If you wish to make a complaint about the way we use your personal information you should raise this with us by contacting us using the details set out in Section 13 below.  

12.2 However, if you are not satisfied with the way we have handled your complaint you have the right to raise the matter with the relevant data protection regulator in your jurisdiction.

You should periodically review this Statement to ensure you understand how we collect and use your personal information.

The website IELJOBS.COM (“Career Site”) may collect, use and store your personal information when you visit the career site, apply for job, or subscribe to job alerts.   

Integrity Express Logistics, LLC (“IEL”) partners with a third-party service provider, Workday, in order collect and process applicant information.

The website ielfreight.com/carriers/ (“Carrier Site”) may collect, use and store your personal information when you seek prequalification and/or join our carrier network.  

Integrity Express Logistics, LLC (“IEL”) partners with a third-party service provider, Highway, in order to onboard carriers and manage its carrier network.  Highway’s privacy policies can be found here.
